Generative AI (GenAI) is revolutionizing how we work, create, and communicate.  This technology is becoming a tool for efficiently completing mundane tasks, significantly boosting productivity and freeing up valuable time for business owners and employees to focus on core operations and growth strategies.  

While GenAI offers significant productivity benefits, organizations must approach its implementation with caution and foresight.  Without a clear GenAI use policy in place that addresses concerns such as data privacy, security measures, and ethical use guidelines, organizations leave themselves exposed to potential legal and compliance issues.    

Key Considerations for Developing a GenAI Use Policy

While not exhaustive, the following points offer a solid foundation for your policy guidelines:

  • Educate employees on GenAI technology to protect against potential third-party claims arising from copyright infringement, invasion of privacy, or defamation
    • What is GenAI 
    • When it can and cannot be used
    • When its use must be disclosed
  • Protect confidential and proprietary information
    • Input of this information into AI tools can potentially expose the information to the public
    • GenAI will collect data such as IP addresses, browser types and usage that may then be shared with third parties
  • Adhere to copyright laws
  • Understand that GenAI tools may be useful but are not a substitute for human judgement and creativity
  • Understand that many AI tools are prone to "hallucinations," false answers or information, or stale information, responses must always be carefully verified by a human
  • Verify that any response from a GenAI tool that you intend to rely on or use is accurate, appropriate, not biased, not a violation of any other individual or entity’s intellectual property or privacy, and consistent with Company policies and applicable laws
  • Do not use GenAI tools to make or help make employment decisions about applicants or employees, including recruitment, hiring, retention, promotions, transfers, performance monitoring, discipline, demotion, or terminations
    • This could result in AI discrimination litigation

Keeping yourself and your staff educated is vital.  While GenAI has the potential to elevate businesses to new levels, it is human interaction and understanding that ultimately drive success.  Establishing a clear usage policy protects the organization and provides a structured framework for employees to explore and utilize AI technologies confidently and ethically.
